Terms of Use

These Terms of Use (“Terms”) govern your access to and use of https://99hellrecords.com (the “Site”), operated by 99 Hell Records. By using the Site you agree to these Terms. If you do not agree, do not use the Site.
1. Use of the Site
You may browse, listen to streaming previews, submit collaboration inquiries, and download materials we explicitly make available for free download (e.g., beats unlocked through the unlock-code system). You may not:
- Use automated tools (scrapers, bots) to extract content beyond what is publicly displayed.
- Reverse-engineer, decompile, or attempt to derive source from any portion of the Site.
- Use the Site to transmit malware, attempt unauthorized access, or interfere with other users.
- Misrepresent your identity or impersonate another person when contacting us.
- Submit fraudulent collaboration inquiries (fake names, fictitious tracks, etc.).
2. Intellectual Property
All content on the Site — including but not limited to audio recordings, beats, lyrics, album artwork, brand logos, photographs, written copy, code, and design — is owned by or licensed to 99 Hell Records and is protected by Canadian and international copyright, trademark, and other intellectual-property laws.
You are granted a limited, non-exclusive, non-transferable license to access and view the content for personal, non-commercial use. Any other use — reproduction, redistribution, public performance, sampling, or commercial use — requires our prior written consent.
Beats made available for free download via the unlock-code system are licensed to the recipient for non-commercial creative use only. Commercial release of any track built around such a beat requires a separate written agreement with us.
3. Submissions
By submitting a collaboration inquiry, demo, voice memo, or other material to us through the Site, WhatsApp, email, or any other channel, you represent that:
- You own or have the right to share the submitted material.
- The material does not infringe on any third party’s intellectual-property or other rights.
- You grant us the non-exclusive right to evaluate the material for potential collaboration. No obligation is created on either side until a separate written agreement is signed.
- If we proceed with a collaboration, terms (including credit, ownership, and compensation, if any) will be set out in a separate written agreement before release.
We do not pay for unsolicited submissions evaluated under our open call. Featured collaborators retain credit and ownership of their contribution per the separate written agreement.
4. Third-party links
The Site contains links to third-party platforms (Instagram, TikTok, YouTube, X, Threads, Spotify, etc.). We are not responsible for the content, privacy practices, or terms of those external sites. Following an external link is at your own discretion.
5. Disclaimers
The Site is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or that defects will be corrected. We do not warrant that audio downloads will be virus-free, though we take reasonable steps to ensure they are.
6. Limitation of liability
To the fullest extent permitted by law, 99 Hell Records shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Site, including but not limited to loss of data, lost profits, or business interruption.
7. Indemnification
You agree to indemnify and hold harmless 99 Hell Records, its operators, contractors, and affiliates from any claim, damage, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any third party’s rights.
8. Termination
We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or applicable law.
9. Governing law
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved in the courts of the District of Montréal, Québec.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected in the effective date at the top of this page. Continued use of the Site after a change constitutes acceptance of the updated Terms.
